Parties:

These Terms and Conditions of Business (“T&Cs") are between  Maritime Executive Recruiters Limited (“Recruitment Consultants”) and you (“Job Seeker”) and will form the basis of your engagement of the Recruitment Consultants.

Recruitment Consultancy Services:

At the Job Seekers request, the Recruitment Consultants undertakes to search for and select potential Clients for presentation for permanent positions subject to the below T&Cs in respect of positions related to Maritime Executive Recruiters. (“Recruitment Services”)

Before presenting any potential Job Seeker, the Recruitment Consultant endeavors to:

Criteria:

Ensure that the potential candidate meets the criteria specified by the Client including having the relevant qualifications and work experience; including the type of work that the potential candidate will be required to undertake, the location and hours of work, the experience, training and qualifications and/or authorizations that the Client deems necessary, the date of commencement of employment, salary expectations, titles and other such details. In order to provide the Recruitment Services, the Job Seeker undertakes to provide the Recruitment Consultants details of all above information, including a detailed CV and recent photo.

Resume:

Take all reasonable steps to confirm the potential Candidate’s resume is a fair and accurate reflection of that person’s profile and career history; and to register the Job Seeker in the Database and commence job seeking procedures once the “Job Seeker” has completed the required form and a follow up phone call from the Recruitment Consultants” has taken place.

Residency:

Take all reasonable steps to ascertain the potential candidate’s residency status,
including “Job Seekers” forms, checklists, C.V. and other related documents, including providing copies of relevant documents etc will not be forwarded to any third party unless the “Job Seeker” specifically instructs us to do so. By applying for an individual vacancy the “Job Seeker” is authorizing us to forward his details to the hiring company (the “Employer”) for that vacancy and in return agrees not to submit any applications for the same vacancy either directly or via any other agency. The “Job Seeker” should ensure that the communication channels provided to us, are secure thus avoiding any uncomfortable situations.

Engagement:

Once the “Recruitment Consultants” arranges engagement, the “Job Seeker” agrees to carefully check the employment contract and any offer letter received from the “Employer” and that the terms and conditions contained in those documents will constitute the terms of employment. The “Job Seeker” agrees that these documents take precedence over any offer communicated between the “Recruitment Consultants” and the “Job Seeker” and that it is the “Job Seekers” responsibility to raise any discrepancies before accepting the Contract or Offer Letter directly with the “Employer.”

The Recruitment Consultant makes no warranty, express, or implied as to the acceptability of the Contract or Offer Letter and it is the sole responsibility of the Job Seeker to review and accept the terms and conditions of Employment Contract or Offer Letter provided by the Employer.

Variation of T&Cs:

No variation can be made to these T&Cs without the prior written consent of the Recruitment Consultants.

Fees & Costs:

The “Recruitment Consultants” will not charge the “Job Seeker” any fees whatsoever for placement services and cannot guarantee to find the “Job Seeker” work however we will endeavor to find placement according to provided qualifications, experience, position applying, salary range and other information as provided by the “Job Seeker”.

Confidentiality:

All introductions from and information provided by the Recruitment Consultants in connection with any potential candidate are strictly confidential. Arrangements between the Job Seeker and the Recruitment Consultant are confidential and shall not be discussed with any third party.

Liability:

The Recruitment Consultants accepts no responsibility for any loss, damage, injury or delay suffered, howsoever caused, arising from the use of the Recruitment Consultants. The Recruitment Consultants also reserve the right to register and/or delete the “Job Seeker” from the database if we consider information provided to us to be illegal, offensive or factually incorrect. We will also remove details/C.V if a complaint is upheld which has been made against the “Employer” and/or if inappropriate behavior towards any member of our staff is conducted.

Governing Law:

These Terms and Conditions of Business shall be governed by Cyprus Law.

At the Client’s request, the Recruitment Consultants undertakes to search for and select potential candidates for presentation to the Client for permanent positions subject to the below T&Cs in respect of positions related to Maritime Executive Recruiters. (“Recruitment Services”)

Before presenting any potential candidate, the Recruitment Consultant endeavors to:

Ensure that the potential candidate meets the criteria specified by the Client including having the relevant qualifications and work experience;

Resume:

Take all reasonable steps to confirm the potential Candidate’s resume is a fair and accurate reflection of that person’s profile and career history.

Residency:

Take all reasonable steps to ascertain the potential candidate’s residency status and notify the Client accordingly including providing copies of relevant documents.

At the specific written request of the Client, the Recruitment Consultant shall endeavor to carry out a maximum of two verbal reference checks with the potential candidate’s previous employers.

In order to provide the Recruitment Services, the Client undertakes to provide the Recruitment Consultants details of the position which the Client seeks to fill, including the type of work that the potential candidate will be required to undertake, the location and hours of work, the experience, training and qualifications and/or authorizations that the Client deems necessary, the date of commencement of employment, salary expectations, titles and other such details.

The Client shall take all steps as necessary to satisfy itself as to the suitability of the potential candidate, and the Client is solely responsible for evaluating references provided by the potential candidate, verifying that the potential candidate has the relevant experience, training, qualifications and authorization required by law or otherwise, obtaining the relevant work permits, arranging medical examinations and/or investigations into the medical history and career history of the potential candidate and satisfying any medical and other requirements, so that the potential candidate can be employed by the Client.

The Recruitment Consultant makes no warranty, express, or implied as to the suitability of any potential candidate introduced to the Client.

Engagement:

The acceptance of a resume, interview or engagement of a potential candidate, or the passing on of personal information about a potential candidate will be taken as the engagement by the Client of the Recruitment Services provide by the Recruitment Consultants notwithstanding that the Client has not returned the signed version of the T&Cs.

Variation of T&Cs:

No variation can be made to these T&Cs without the prior written consent of the Recruitment Consultants.

Fees & Costs:

A fee is payable by the Client to the Recruitment Consultants in respect of any potential candidate introduced to the Client personally or in writing by the Recruitment Consultant, interviewed for a position and who is subsequently engaged by the Client within six (6) months of the initial introduction by the Recruitment Consultants.

A flat fee of  15 % is calculated on basis of the gross annual salary, including base salary or fees, allowances, commissions, profit share or guaranteed performance bonus, living or accommodation allowances; car allowances, and all other benefits which form part of the total remuneration package, and excluding VAT (if applicable) (“Fee”). Profit share or guaranteed performance bonus will be based on projected value.

In the event the Client introduces a potential candidate introduced by the Recruitment Consultants to any other party and this resulting in the potential candidate being engaged by that other person the, Client will be liable to pay the Fee to the Recruitment Consultant.

All Fees and Costs and other sums shall be invoiced and paid in EURO.

The Client is required to pay the Fee to the Recruitment Consultants within SEVEN (7) working days of the commencement of employment.

Any queries relating to an invoice must be raised in writing to the Recruitment Consultants within five (5) days of the receipt of an invoice.

The Client agrees to notify the Recruitment Consultants immediately if a potential candidate introduced by the Recruitment Consultants accepts an offer of employment made by the Client.

Default Interest:

If the Client fails to make payment of any amount payable under these T&Cs on the due date for payment, the Client shall be liable to pay interest on the unpaid amount at the interest rate of 2% per day until payment of outstanding amounts is received by the Recruitment Consultants.

Refunds:

In the event that the potential candidate or the Client terminates employment within twelve (12) weeks from the date the potential candidate commenced employment with the Client, the Recruitment Consultants shall reimburse the Client as follows:

  • If a potential candidate leaves within eight weeks:50% of the Fee;
  • If a potential candidate leaves within eight to twelve weeks: 25% of the Fee.

This reimbursement is subject to the following conditions having been met:

  • The Client notifies the Recruitment Consultants in writing of the termination of employment within seven (7) days of the termination;
  • All monies due from the Client have been paid in accordance with these T&Cs and termination is not due to redundancy or to a material change in the potential candidate’s job description;
  • The Client or any parent, subsidiary, associated company of the Client shall not engage the potential candidate within twelve (12) months from the date of the termination of the employment.

Confidentiality:

All introductions from and information provided by the Recruitment Consultants in connection with any potential candidate are strictly confidential. Fee arrangements between the Client and the Recruitment Consultant are confidential and shall not be discussed with any third party.

Liability:

The Recruitment Consultants accepts no responsibility for any loss, damage, injury or delay suffered, howsoever caused, arising from the use of the Recruitment Consultants.

Governing Law:

These Terms and Conditions of Business shall be governed by Cyprus Law.
